Sabunese Customary Approaches to Adultery: A Comprehensive Analysis of Legal Resolution
Keywords:
Sabunese, Customary Law, AdulteryAbstract
Adultery, as a complex and sensitive issue, is addressed within the framework of various legal systems, including customary law. This study, Sabunese Customary Approaches to Adultery: A Comprehensive Analysis of Legal Resolution, explores how adultery cases are resolved under Sabunese customary law, offering insights into the traditional legal mechanisms, social norms, and cultural values that shape its outcomes. The research examines the procedural aspects of adultery cases, the role of community elders, and the influence of customary practices on determining guilt, punishment, and reconciliation. By analyzing case studies and legal narratives from the Sabunese context, the study highlights the tension between traditional values and modern legal frameworks in resolving disputes related to adultery. It also discusses the implications of such customary resolutions on social harmony, gender roles, and the community’s perception of justice. The findings suggest that while Sabunese customary law emphasizes restorative justice and reconciliation, it also reflects broader societal norms, especially concerning gender, power dynamics, and community welfare. The study concludes with recommendations for balancing customary practices with contemporary legal frameworks to ensure justice, equity, and cultural preservation.
